By accessing or using NexusCall AI's services, website, or platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you ("Client," "you") and NexusCall AI ("we," "our," "us").

2. Description of Services

NexusCall AI provides AI-powered voice agent services for businesses, including but not limited to: automated call answering, appointment scheduling, lead capture, call forwarding, message taking, and integration with third-party business tools. Our AI agents are designed to represent your business professionally and handle inbound calls on your behalf.

3. Account Registration

To use our services, you must provide accurate and complete information during registration. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

  • Billing Cycle: Subscriptions are billed monthly. Your billing cycle begins on the date you subscribe.
  • Payment: All payments are processed securely through Stripe. You authorize us to charge your payment method on a recurring basis.
  • Plan Changes: You may upgrade or downgrade your plan at any time. Changes take effect at the start of your next billing cycle.
  • Setup Fee: A one-time setup fee may apply depending on your plan and any promotional offers in effect.

5. 7-Day Money-Back Guarantee

We offer a 7-day money-back guarantee on all plans. If you are not satisfied with our services within the first 7 days of your subscription, you may request a full refund of your monthly subscription fee. Setup fees are non-refundable after your AI agent has been configured and deployed.

6. Acceptable Use

You agree not to use our services to:

  • Engage in any illegal, fraudulent, or deceptive activities
  • Harass, threaten, or harm any individual
  • Transmit spam, unsolicited communications, or robocalls
  • Violate any applicable local, state, national, or international law
  • Infringe upon the intellectual property rights of others
  • Attempt to reverse engineer, decompile, or extract our AI technology

7. Service Level

We strive to maintain 99.9% uptime for our AI voice agent services. In the event of planned maintenance, we will provide advance notice. We are not liable for service interruptions caused by factors beyond our reasonable control, including but not limited to telecommunications failures, internet outages, or force majeure events.

8. Intellectual Property

All content, technology, and intellectual property associated with NexusCall AI's platform remain our exclusive property. You retain ownership of your business data, call recordings, and any content you provide to customize your AI agent. You grant us a limited license to use your business information solely for the purpose of providing our services.

9. Limitation of Liability

To the maximum extent permitted by law, NexusCall AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim.

10. Cancellation

You may cancel your subscription at any time. Upon cancellation, your AI agent will continue to operate until the end of your current billing period. After that, call handling will cease and your data will be retained for 30 days before deletion, allowing you to reactivate if desired.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or through our platform. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Palm Beach County, Florida.
